Agreement to Terms

Welcome to nomatch — the companion app for nomads.

These Terms of Service ("Terms") govern your access to and use of the nomatch mobile application ("App") and related services. By creating an account or using nomatch, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the App. We may update these Terms from time to time, and your continued use constitutes acceptance of any changes.

Eligibility

To use nomatch, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the App under applicable law
• Not have been previously banned from nomatch

By using nomatch, you represent and warrant that you meet all eligibility requirements.

Account Registration

Invite-Only Access

nomatch is an invite-only community. To create an account, you must:

• Receive a valid invite code from an existing member, or
• Join the waitlist and receive a code when space becomes available

Invite codes are single-use and non-transferable. Selling, trading, or publicly distributing invite codes is prohibited and may result in account termination.

Sign in with Apple

Account creation requires Sign in with Apple. You are responsible for maintaining the security of your Apple ID and any activity that occurs under your account.

Accurate Information

You agree to provide accurate, current, and complete information during registration and to update your information as needed. Misrepresenting your identity, age, or other material facts is grounds for account termination.

Community Guidelines

nomatch is built on trust and mutual respect. By using the App, you agree to:

Be Respectful

• Treat other members with courtesy and respect
• Accept "no" gracefully — not everyone will want to connect
• Respect others' privacy and boundaries
• Use appropriate language in all communications

Be Authentic

• Use recent, accurate photos of yourself
• Represent your lifestyle and intentions honestly
• Don't impersonate others or create fake profiles

Be Safe

• Meet in public places for first meetups
• Tell someone where you're going
• Trust your instincts — if something feels off, it probably is
• Report concerning behavior to help protect the community

Prohibited Conduct

The following activities are strictly prohibited and will result in immediate account termination:

Harassment and Abuse

• Harassment, bullying, intimidation, or stalking
• Hate speech, discrimination, or slurs based on race, ethnicity, religion, gender, sexual orientation, disability, or any other characteristic
• Threats of violence or harm
• Unwanted sexual content or advances
• Doxxing or sharing others' private information

Illegal Activity

• Any illegal activity or solicitation of illegal activity
• Soliciting or offering prostitution or escort services
• Drug trafficking or solicitation
• Fraud, scams, or phishing

Spam and Commercial Use

• Spam, advertising, or promotional content
• Soliciting money from other users
• Using nomatch for commercial purposes without authorization
• Automated account creation or scraping

Platform Abuse

• Creating multiple accounts
• Circumventing bans or suspensions
• Interfering with the App's operation or security
• Reverse engineering or attempting to access source code

Content Ownership

Your Content

You retain ownership of the content you post (photos, bio, messages). By posting content, you grant nomatch a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content solely for the purpose of operating the App.

Content Restrictions

You may not post:

• Content you don't have the right to share
• Explicit sexual content or nudity
• Violent or graphic content
• Content depicting minors
• Content that violates any law or regulation

Our Content

The nomatch name, logo, design, and other intellectual property are owned by nomatch. You may not use our trademarks or copyrighted material without written permission.

Subscriptions and Payments

Free and Premium Tiers

nomatch offers both free and premium (nomatch+) tiers. The free tier provides full core functionality. Premium features are optional enhancements.

Billing

Premium subscriptions are billed through Apple's App Store. By subscribing, you agree to Apple's terms of service for in-app purchases. Subscription fees are charged at the beginning of each billing period.

Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

Price Changes

We may change subscription prices with reasonable notice. Price changes will apply to your next billing cycle after the change takes effect.

Safety and Reporting

Reporting

If you encounter behavior that violates these Terms or makes you uncomfortable, please report it immediately using the in-app reporting feature. We review all reports and take appropriate action.

Blocking

You can block any user at any time. Blocked users cannot see your profile, send you messages, or interact with you in any way.

No Guarantee of Safety

While we work to maintain a safe community, we cannot guarantee the behavior of any user. You are responsible for your own safety when meeting people from the internet. nomatch is not responsible for the actions of its users.

Termination

By You

You may delete your account at any time through the Profile tab in the App. Account deletion is permanent and cannot be undone.

By Us

We may suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Violation of Community Guidelines
• Conduct that harms other users or the community
• Fraudulent or illegal activity
• Extended inactivity

Effect of Termination

Upon termination, your right to use the App ceases immediately. Your profile and data will be deleted in accordance with our Privacy Policy.

Disclaimers

As-Is Service

nomatch is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, secure, or error-free.

No Matchmaking Guarantee

We do not guarantee that you will find connections, friends, or romantic partners through nomatch. The App is a tool to facilitate connections; the outcome depends on you and other users.

Third-Party Services

nomatch uses third-party services (Apple CloudKit, Stream, RevenueCat). We are not responsible for the availability or performance of these services.

Limitation of Liability

To the maximum extent permitted by law:

• nomatch and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability for any claims arising from your use of the App shall not exceed the amount you paid to nomatch in the 12 months preceding the claim, or $100, whichever is greater
• We are not liable for the conduct of any user, whether online or offline

Indemnification

You agree to indemnify and hold harmless nomatch and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your content posted on the App

Dispute Resolution

Informal Resolution

Before filing a formal dispute, please contact us at support@nomatch.app. We'll work with you to resolve issues informally whenever possible.

Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in class action lawsuits.

General Provisions

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and nomatch regarding your use of the App.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights to any affiliate or successor.

Changes to These Terms

We may modify these Terms at any time. When we make changes:

• We'll update the "Last Updated" date at the top
• For significant changes, we'll notify you through the App or via email
• Continued use of nomatch after changes constitutes acceptance

If you disagree with any changes, your remedy is to stop using the App and delete your account.
